OVERVIEW

Welcome to Merry Canvas.

The terms “Merry Canvas,” “we,” “us,” and “our” refer to Merry Canvas. We operate this website and online store, including the information, content, features, products, tools, and services made available through it (collectively, the “Services”).

Our store is powered by Shopify, which provides the e-commerce platform that allows us to offer our products and Services to you.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies referenced on our website, govern your access to and use of the Services and purchases made from Merry Canvas.

By accessing our website, placing an order, or otherwise using the Services, you agree to these Terms.

If you do not agree with these Terms, you should not use the Services or place an order.

Nothing in these Terms excludes or limits rights that cannot legally be excluded under applicable consumer protection law.

SECTION 1 — ELIGIBILITY AND ACCOUNT INFORMATION

By using the Services, you represent that you have reached the age required to enter into a legally binding agreement in your jurisdiction or that you are using the Services with the permission of a parent or legal guardian where required.

When placing an order, you agree to provide current, complete, and accurate information, including your:

Name
Email address
Shipping information
Billing information
Payment information
Telephone number where requested

You are responsible for ensuring that all information submitted is accurate before completing your purchase.

We are not responsible for delivery problems caused by inaccurate, incomplete, or outdated customer information, except where required otherwise by law.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to accurately display and describe our products.

However, product appearance may vary slightly because of:

Screen settings
Device displays
Lighting
Photography
Printing
Manufacturing tolerances
Textile production
Material batches

Minor differences that do not materially change the product are not necessarily defects.

Nothing in this section permits us to supply a product materially different from what was advertised or ordered.

SECTION 3 — REGULAR AND PREMIUM COLORING BLANKETS

Merry Canvas may offer different versions of its coloring blankets, including Regular and Premium versions.

These are separate product options with different characteristics.

Customers are responsible for reviewing and selecting the desired version before completing checkout.

Regular Version

The Regular version is intentionally a lighter and thinner product than the Premium version.

Customers acknowledge that:

The Regular version has a lightweight construction.
It may feel thin compared with the Premium version or with thicker household blankets.
Some customers may personally consider the Regular version very thin.
Its thickness, weight, texture, and feel may differ from what an individual customer personally expected.
Purchasing the Regular version and later deciding that you would have preferred the Premium version does not by itself mean that the Regular product is defective.

If the Regular version supplied materially matches the product and version ordered, subjective dissatisfaction with its thickness, weight, feel, or construction does not convert the product into a damaged, defective, or incorrect item.

An otherwise eligible unused Regular product may still be returned under our voluntary Refund Policy, including applicable return-shipping requirements.

Premium Version

The Premium version is an upgraded version intended for customers who prefer a more substantial product.

Its characteristics may include differences in thickness, construction, material, weight, texture, finish, or other characteristics identified on the applicable product page.

The exact specifications shown on the product page at the time of purchase govern the version purchased.

Customers should carefully check their selected version before checkout.

SECTION 4 — COLORING, MARKERS AND BLEED-THROUGH

Our products are intended to be colored using appropriate coloring materials.

Marker ink may bleed through, transfer through, or penetrate the material.

The likelihood and amount of bleed-through may depend on factors including:

Type of marker
Amount of ink
Ink saturation
Repeated coloring over the same area
Pressure
Coloring technique
Material thickness
Surface underneath the blanket

Permanent markers and other high-ink-flow markers may be particularly likely to transfer through material.

Unless a particular product page expressly states otherwise, Merry Canvas coloring blankets should not be considered completely bleed-proof.

Surface Protection

Customers must use an appropriate protective barrier underneath the product while coloring.

Do not color directly over:

Furniture
Bedding
Carpet
Flooring
Upholstery
Clothing
Valuable tables or desks
Other surfaces that could be stained

Customers should test their coloring materials where appropriate and adequately protect surrounding surfaces.

Merry Canvas is not responsible for staining, ink transfer, discoloration, or property damage caused by failure to use reasonable surface protection, to the maximum extent permitted by applicable law.

Marker bleed-through consistent with the disclosed characteristics and intended coloring use of the product does not, by itself, establish that the product is defective.

Nothing in this section limits rights relating to a genuinely defective or materially misrepresented product.

SECTION 5 — CHILDREN AND SUPERVISION

Where our products are used by children, appropriate adult supervision is recommended.

Markers and coloring materials may stain skin, clothing, furniture, flooring, bedding, or other property.

Customers are responsible for using coloring supplies in accordance with any warnings and instructions provided by their respective manufacturers.

Merry Canvas is not responsible for misuse of third-party coloring materials.

SECTION 6 — ORDERS

Submitting an order constitutes an offer to purchase the selected products.

We reserve the right, where legally permitted, to accept, reject, limit, or cancel an order for legitimate reasons, including:

Product unavailability
Pricing errors
Suspected fraud
Payment issues
Incorrect product information
Shipping limitations
Orders placed for unauthorized resale
Technical errors

Receiving an order confirmation does not necessarily mean an order has already entered fulfillment.

Once an order has entered processing or fulfillment, we may be unable to modify or cancel it.

Customers are responsible for reviewing:

Product
Design
Version
Quantity
Shipping address
Contact information

before completing checkout.

SECTION 7 — ORDER CHANGES AND CANCELLATIONS

We will make reasonable efforts to accommodate order-change or cancellation requests submitted before fulfillment begins.

However, because orders may be transmitted to fulfillment partners shortly after purchase, changes and cancellations are not guaranteed after an order has been submitted.

An unsuccessful request to cancel after fulfillment has begun does not remove a customer's rights under our Refund Policy or mandatory applicable consumer law.

SECTION 8 — PRICES AND PAYMENT

Prices and promotions may change without notice.

The amount charged will be the amount displayed and accepted during checkout, subject to correction of obvious errors where legally permitted.

Customers agree to provide valid and authorized payment information.

By submitting payment information, you represent that you are authorized to use the selected payment method.

Taxes, shipping, duties, customs charges, and other charges will be handled as stated at checkout or under applicable law.

SECTION 9 — SHIPPING AND FULFILLMENT

Merry Canvas works with international suppliers, logistics companies, fulfillment partners, and carriers.

Products may therefore be:

Manufactured internationally
Fulfilled internationally
Shipped from overseas facilities
Transferred between multiple carriers
Subject to customs processing

Shipping and delivery times displayed on our website are estimates unless expressly stated otherwise.

Delays may occur because of circumstances outside our reasonable control, including:

Customs
Carrier delays
Severe weather
Holiday shipping volume
Transportation disruptions
Customs inspections
Incorrect addresses
Failed delivery attempts
Local postal delays

Where legally permitted, we are not liable for reasonable shipping delays caused by circumstances outside our control.

Mandatory consumer rights remain unaffected.

SECTION 10 — DELIVERY INFORMATION

Customers are responsible for entering a complete and accurate shipping address.

If an order cannot be delivered because the customer supplied incorrect or incomplete information, the customer may be responsible for additional shipping costs where permitted by law.

Customers should monitor tracking information and cooperate with the local carrier where action is required to complete delivery.

A parcel being returned because it was:

Refused
Unclaimed
Not collected
Unable to be delivered because of customer-provided information
Returned following unsuccessful delivery attempts

does not automatically entitle the customer to an immediate refund.

Any refund or reshipment will be handled according to our Refund Policy and applicable law.

SECTION 11 — RETURNS

Returns are governed by our Refund Policy, which forms part of these Terms.

For our voluntary return program, customers must generally contact us within 14 days after confirmed delivery to request a return.

A return request does not automatically mean the return has been approved.

Customers must receive return instructions before mailing a product.

Products sent without authorization may not be accepted.

Where a return is approved, applicable eligibility requirements and deadlines contained in the Refund Policy apply.

Mandatory statutory cancellation or return rights are not restricted by this section.

SECTION 12 — INTERNATIONAL RETURN SHIPPING

Merry Canvas works with international fulfillment partners.

As a result, an approved return may need to be sent to an overseas return warehouse.

For voluntary change-of-mind returns, the customer is responsible for return-shipping costs, unless:

We expressly agree otherwise; or
Applicable law requires otherwise.

International return shipping can be expensive.

Customers should consider this before purchasing.

Return Address

The return facility used for an order may depend on the:

Product
Supplier
Country
Fulfillment facility
Logistics arrangement

For this reason, our return warehouse is subject to change.

The authorized return destination will be provided by Merry Canvas after a return request is reviewed.

Customers must not send products back without obtaining the current authorized return instructions from us.

Do not automatically return merchandise to the sender address printed on the parcel.

That address may belong to a:

Shipping carrier
Freight forwarder
Export warehouse
Logistics company
Temporary fulfillment facility

and may not accept customer returns.

Customers are responsible for packages sent to unauthorized, incorrect, or outdated return locations where permitted by law.

SECTION 13 — CHANGE OF MIND AND SUBJECTIVE DISSATISFACTION

Unless applicable law provides otherwise, personal preference does not make a product defective.

Examples include:

Deciding you no longer want the product.
Preferring another design after receiving your order.
Ordering the Regular version and later wanting Premium.
Believing the Regular version feels thinner than personally expected where its lightweight construction was disclosed.
Preferring another texture or feel.
Ordering the incorrect version.
Ordering the incorrect quantity.
Minor variations in printing or appearance.
Reasonable screen-to-product color differences.

Where our voluntary return policy permits a return for such reasons, the customer must follow that return process and is responsible for applicable return-shipping costs.

A customer is not automatically entitled to:

Keep the merchandise and receive a full refund;
Receive free international return shipping; or
Treat a disclosed product characteristic as a product defect

merely because the customer does not personally like the product.

Mandatory consumer rights remain unaffected.

SECTION 14 — USED AND COLORED PRODUCTS

Coloring, writing on, drawing on, washing, staining, modifying, or otherwise materially using a coloring blanket may affect eligibility for a voluntary return.

Once a customer begins coloring the product, it may no longer be capable of being resold as new.

Customers should therefore inspect the:

Product
Design
Version
Material
General condition

before beginning to color it.

Rights relating to genuinely defective or non-conforming products remain subject to applicable law.

SECTION 15 — DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

Customers should inspect their order promptly after delivery.

If a product arrives:

Damaged
Defective
Incorrect
Missing an item or component

We may reasonably request evidence required to investigate the claim, including:

Order number
Photographs
Video
Packaging photographs
Shipping-label photograph
Description of the problem

Customers should retain the merchandise and packaging while the claim is being reviewed.

Where a product is confirmed to be defective, damaged, or materially different from what was ordered, we will provide the remedy required under applicable law and/or our Refund Policy.

SECTION 16 — REFUNDS

Refund eligibility is governed by our Refund Policy and applicable law.

Where a physical return is required, we may wait until:

The returned product is received; or
Appropriate proof of return is provided

before issuing a refund, where legally permitted.

A refund does not necessarily include:

Voluntary return postage
Customs expenses
Duties
Expedited shipping upgrades
Other non-refundable charges

unless applicable law requires otherwise.

Approved refunds are issued to the original payment method unless another method is required or agreed.

Financial institutions may require additional processing time after a refund has been issued.

SECTION 17 — PAYMENT DISPUTES AND CHARGEBACKS

Customers are encouraged to contact us at contactmerrycanvas@gmail.com before initiating a payment dispute so that we have an opportunity to investigate and resolve the issue.

Nothing in these Terms removes any legitimate chargeback or payment-dispute right provided by law or by the applicable payment provider.

However, filing a payment dispute does not create additional refund rights or automatically establish that:

An item was defective;
An item was not delivered;
An item was unauthorized;
The wrong version was supplied; or
A customer qualifies for a refund.

If a payment dispute or chargeback is filed, Merry Canvas may submit relevant evidence to the payment provider, including:

Order confirmation
Payment records
Checkout records
IP or fraud-prevention information where lawfully collected
Shipping records
Tracking information
Delivery confirmation
Product-page disclosures
Regular/Premium version selected
Return-policy disclosures
Customer correspondence
Photographs
Videos
Prior refund or replacement offers
Other evidence relevant to the transaction

We reserve the right to contest disputes we reasonably believe are unsupported, inaccurate, misleading, duplicative, abusive, or fraudulent.

Knowingly making false statements in connection with a payment dispute may constitute a breach of these Terms and may have additional consequences under applicable law.

SECTION 18 — PRODUCT PHOTOS AND REPRESENTATIONS

We attempt to display products accurately.

However, photographs, videos, advertisements, and digital displays cannot perfectly reproduce every physical characteristic of a textile product.

Screen brightness, display calibration, lighting, camera settings, and manufacturing variation may result in reasonable differences.

This section does not permit material misrepresentation and does not relieve us of responsibility where goods materially fail to conform to what was advertised.

SECTION 19 — PROMOTIONS AND DISCOUNTS

Promotional offers may be:

Limited in duration
Limited in quantity
Restricted to certain products
Restricted by location
Subject to separate conditions

Unless expressly stated otherwise, discount codes cannot be combined.

We may correct obvious promotional or pricing errors where permitted by law.

SECTION 20 — INTELLECTUAL PROPERTY

Unless otherwise indicated, our website content, branding, text, graphics, logos, photographs, layouts, videos, product presentations, and other original materials are owned by or licensed to Merry Canvas and are protected by applicable intellectual-property laws.

You may use our Services only for personal and lawful purposes.

You may not, without authorization:

Copy
Republish
Distribute
Sell
Reproduce
Scrape
Modify
Commercially exploit

our protected content.

Third-party trademarks and intellectual property remain the property of their respective owners.

SECTION 21 — SHOPIFY AND THIRD-PARTY SERVICES

Merry Canvas is powered by Shopify.

Shopify provides the technology that enables us to operate our online store but is not the seller of Merry Canvas products.

Purchases are made from Merry Canvas rather than Shopify.

We may also use third-party services for functions including:

Payment processing
Analytics
Advertising
Fulfillment
Customer support
Shipping
Fraud prevention

Third-party services may be governed by their own terms and privacy policies.

SECTION 22 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store uses Shopify and other service providers, information may be processed by Shopify and other third parties involved in providing our Services.

Please review our Privacy Policy for additional information.

SECTION 23 — PROHIBITED USE

You may not use our Services:

For unlawful purposes.
To violate applicable laws or regulations.
To infringe intellectual-property rights.
To submit fraudulent orders.
To engage in payment fraud.
To transmit malware.
To interfere with website security.
To impersonate another person.
To provide knowingly false information.
To collect personal information unlawfully.

We may restrict or terminate access to the Services where reasonably necessary to address misuse, fraud, security concerns, or violations of these Terms.

SECTION 24 — REVIEWS, FEEDBACK AND USER CONTENT

If you voluntarily submit reviews, photographs, suggestions, comments, or other content to us, you represent that you have the right to provide that material.

You must not submit content that:

Infringes another person's intellectual property.
Violates privacy rights.
Contains malicious software.
Is unlawful.
Is knowingly false or misleading.

To the extent permitted by law, you grant Merry Canvas a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and share content you intentionally submit for review, marketing, operational, or promotional purposes.

This does not transfer ownership of your original content to us.

SECTION 25 — ERRORS AND INACCURACIES

Our website may occasionally contain:

Typographical errors
Pricing mistakes
Product-description errors
Availability errors
Shipping-estimate errors
Other inaccuracies

We reserve the right to correct such errors and update information.

Where an error affects an existing order, we will handle the situation in accordance with applicable law.

SECTION 26 — DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the Services are provided on an “as available” basis.

We do not guarantee that the website will always be:

Uninterrupted
Error-free
Secure
Available at every time

Any warranty disclaimer in these Terms applies only to the extent that such warranty may lawfully be excluded.

Nothing in these Terms eliminates statutory warranties, guarantees, or consumer rights that cannot legally be waived.

SECTION 27 — LIMITATION OF LIABILITY

To the maximum extent permitted by law, Merry Canvas and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the Services or products.

Without limiting the above, and where permitted by law, Merry Canvas is not responsible for loss or damage caused by:

Misuse of a product.
Failure to follow instructions or warnings.
Failure to protect surfaces while coloring.
Marker transfer or staining where bleed-through risk was disclosed.
Use of inappropriate coloring materials.
Unauthorized product modification.
Circumstances outside our reasonable control.

Nothing in these Terms excludes liability where exclusion is prohibited by law.

In particular, nothing in these Terms limits mandatory rights relating to defective, unsafe, misrepresented, or non-conforming goods.

SECTION 28 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify Merry Canvas against third-party claims arising directly from:

Your unlawful use of the Services;
Your material violation of these Terms;
Your infringement of another party's rights; or
Content you submit in violation of applicable law.

This section does not require consumers to indemnify Merry Canvas for Merry Canvas's own unlawful conduct, negligence where liability cannot legally be excluded, or breach of mandatory consumer rights.

SECTION 29 — EVENTS OUTSIDE OUR CONTROL

We are not responsible for failure or delay caused by circumstances outside our reasonable control, including:

Natural disasters
War
Civil unrest
Government action
Carrier interruptions
Customs delays
Labor disruptions
Severe weather
Transportation disruptions
Internet outages
Supply-chain disruptions

This provision applies only to the extent permitted by applicable law.

SECTION 30 — INTERNATIONAL CUSTOMERS

Customers purchasing from outside Canada may be subject to consumer laws in their country of residence.

These Terms are not intended to waive mandatory rights that cannot legally be waived.

Where mandatory consumer law conflicts with these Terms, the mandatory law will apply to the extent of the conflict.

European Union Customers

Where the European Union's statutory distance-selling withdrawal rules apply, eligible consumers generally have 14 days after delivery to withdraw from an online purchase without giving a reason, subject to applicable exceptions.

Where legally permitted and properly disclosed before purchase, the customer is responsible for the direct cost of returning merchandise following a change-of-mind withdrawal.

Separate rights may apply where goods are genuinely faulty or do not conform to what was advertised.

SECTION 31 — SEVERABILITY

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed where necessary.

The remaining provisions will continue in effect.

SECTION 32 — NO WAIVER

If we do not immediately enforce a provision of these Terms, that does not mean we permanently waive our right to enforce it.

SECTION 33 — ENTIRE AGREEMENT

These Terms, together with our:

Refund Policy
Privacy Policy
Shipping Policy
Product-page disclosures
Checkout terms
Any other policies expressly incorporated by reference

constitute the agreement governing use of the Services and purchases from Merry Canvas, subject to applicable law.

If a mandatory consumer-protection law conflicts with these Terms, the mandatory law prevails.

SECTION 34 — GOVERNING LAW

These Terms and your use of the Services are governed by the laws of Ontario and the federal laws of Canada applicable therein, without depriving consumers of mandatory protections provided by the laws that legally apply to them.

To the extent legally permitted, disputes relating to these Terms will be brought before courts with appropriate jurisdiction in Ontario, Canada.

Nothing in this section prevents a consumer from exercising a right to bring a proceeding elsewhere where applicable consumer law expressly permits or requires it.

SECTION 35 — CHANGES TO THESE TERMS

We may update these Terms from time to time.

The current version will be posted on this page with an updated revision date.

Changes will not retroactively remove rights that have already arisen under an existing transaction where doing so would be prohibited by law.

Material changes will be communicated where required by applicable law.

SECTION 36 — POLICY PRIORITY

Our Refund Policy contains the detailed conditions governing returns and refunds.

Our product pages contain product-specific disclosures, including information relating to Regular and Premium versions.

If there is an inconsistency:

Mandatory applicable law controls first.
Product-specific terms control matters specific to that product.
The Refund Policy controls return and refund procedures.
These Terms otherwise govern use of the Services.
